This agreement constitutes a legal agreement between the user of the site and Nordik Radiant, with respect to the Nordik Radiant web site.

By using the Nordik Radiant website, you agree to be bound by the terms and conditions of this agreement for as long as you remain on the Nordik Radiant website. If you do not wish to be bound by this Agreement, do not use the Nordik Radiant site. The terms and conditions of the contract may be changed at any time without notice. They will automatically come into effect.
1. Acceptance of Terms of Service
The Nordik Radiant site offers its users access to the information available at the time of connection. The site also offers a range of products and services allowing the user differentiated access to information and other content specific to the Nordik Radiant site. These general conditions apply to all products and services provided by Nordik Radiant. By using the services offered, the client declares to use the services offered by the Nordik Radiant site in accordance with the applicable law and the following general conditions.
2. Copyright and trademarks
All Content (texts, illustrations, images, codes and URLs) reproduced on the Nordik Radiant site as well as their selection, composition and arrangement belong to Nordik Radiant or are licensed to third parties and are protected by copyright for the entire world. Any total or partial reproduction of the Contents of the Nordik Radiant site is strictly prohibited. No license or right to use the Contents is granted to users of the Nordik Radiant site. You are prohibited, for commercial or profit-making purposes, from modifying, copying, distributing, publishing, transmitting, broadcasting, reproducing, compiling, arranging or saving the Contents or creating compilations, including all or part of the Contents, or transferring the Contents to anyone in any way whatsoever, including by reproducing and transmitting an excerpt of the Contents accompanied or not by a hyperlink. It is also forbidden to sell or profit in any way from any information, software, product or service obtained from the Nordik Radiant site, or to create compilations and derivative works of the aforementioned elements.
3. User Name, Password
You are responsible for maintaining the confidentiality of your client account. Nordik Radiant will not be liable for any unauthorized use of your account. In the event that the confidentiality of this information is compromised, please notify our service as soon as possible at info@Nordik Radiant.ca to avoid possible fraudulent use of your account. Nordik Radiant will not be liable for any loss or damage resulting from, among other things, failure to comply with the security measures set forth in this section. In this regard, you are advised to carefully read the LIMITATION OF LIABILITY contained in these Terms of Use to understand the extent of your responsibilities with respect to the Nordik Radiant site services.
4. Use of Online Communication Services
You are solely responsible for the content you post through our services (forums, emails, blogs, RSS feeds, etc.) and for the consequences of that content. You may not use the Nordik Radiant services to conduct or send any surveys, contests, pyramid schemes or chain letters, spamming, hacking or any other act for illegal purposes. You are also prohibited from engaging in any act that may infringe on the rights of others and their enjoyment of the service. Although Nordik Radiant reserves the right to delete certain data, all at its own discretion, this remains an option and not an obligation. Nordik Radiant makes no representations regarding control of the content of the information available on the site, given the volume and speed of data transmission on the service. Nordik Radiant also reserves the right to ban you from interactive online services. Nordik Radiant reserves the right to take action against any user who violates the rules of netiquette.
5. Safety of Children and Teens on the Internet
More and more children and teenagers are using Internet services and benefiting from them. However, as in any other environment, they can become the target of crime or exploitation because they are more vulnerable. That’s why we recommend that you monitor your children’s and teens’ use of your Internet service and provide them with some common sense safety tips and recommendations. These recommendations will help your children and teens navigate the Internet in an informed manner and will help you ensure that your children and teens take full advantage of all the features the service provides to enrich their development.
6. Illegal Content
It is forbidden to include in the Nordik Radiant site any defamatory, obscene, offensive, violent or racist texts, nor any illegal material that would violate the intellectual property of others, under penalty of legal action. The user undertakes to use the Nordik Radiant services in compliance with the laws in force.
7. Security and efficiency of the network
Nordik Radiant does not guarantee total efficiency or security. It is possible for a hacker to gain access to the server. It is therefore important to keep in mind that it is always possible that a malicious individual could access the Nordik Radiant website servers and use, for his own purposes, some of the personal information left by users. Under no circumstances will Nordik Radiant or its administrators be held responsible for any hacking attempt or any loss or damage that may be incurred by any user of the Nordik Radiant Web site. The Nordik Radiant website may experience occasional outages and some programming errors may be caused by updates or events beyond the control of the administrators.
Neither the administrators nor any member of the organization will be held responsible if a member is unable to navigate the Nordik Radiant website for any reason (misunderstanding, faulty phone line, incompatible modem, broken cable, bad configuration, bad browser, etc.).
8. External links
Nordik Radiant or a third party may link to other sites or sources. Nordik Radiant has no means of controlling these sites and sources, and is not responsible for the availability of such external sites and sources, nor does it guarantee them. Nordik Radiant does not endorse or approve of the contents to which these sites or sources give access, and excludes all responsibility and guarantee with regard to these contents.
9. Payment and Payment Terms
1. Prices
Prices for our products are quoted in Canadian or U.S. dollars with applicable taxes added (where applicable). All orders, regardless of their origin, are payable in Canadian or U.S. dollars. Nordik Radiant reserves the right to change its prices at any time. Products are always invoiced on the basis of the rates in effect at the time the order is placed.
2. Payment
The payment of your purchases on our website is made by credit card. They are all accepted as well as American Express, MasterCard and Visa international cards. The proposed fees must be paid according to the payment procedure described during the registration process. The customer agrees to pay the total cost and charges for the product purchased, including taxes. Nordik Radiant may change the price after notifying the customer. The client is solely responsible for the actual payment of the product purchased. Only the user is responsible for the payment by credit card of the service offered. Nordik Radiant is not responsible for payment problems related to the operation of the e-commerce service.
3. Payment security
The Nordik Radiant site is subject to a security system. In these cases, the Nordik Radiant site has also strengthened all the processes of scrambling and encryption to protect as effectively as possible all vulnerable data related to payment methods.
4. Out of stock product
When a product is the subject of a special purchase, Nordik Radiant reserves the right to require a 25% non-refundable deposit. All orders for out-of-stock products cannot be cancelled or returned without prior consent from Nordik Radiant.
10. Limitation of Liability
Nordik Radiant and its employees shall not be liable for any damages, including compensatory, direct or indirect, or any other damages of any kind that may be caused to users or any other person or entity, by any technical or technological equipment on the Nordik Radiant site or by any human or technical error that may occur at any stage, technical problems or malfunctions of the electronic or communications network, computer on-line systems, servers, computer equipment, software, data transmissions or any other technical problems or congestion on the website or otherwise.
11. Applicable Law
This Terms of Service Agreement shall be governed by the laws applicable in the Province of Quebec. You hereby acknowledge that any dispute arising out of or relating to the use of Nordik Radiant services and website shall be subject to the jurisdiction of the courts of the district of Montreal, province of Quebec.
12. Indemnification
You hereby agree to indemnify and hold Nordik Radiant harmless in the event of any legal action being taken against Nordik Radiant as a result of any violation of these terms of use by you or any user of your access to the Nordik Radiant site.
13. Force Majeure
Nordik Radiant will not be liable for the non-performance, in whole or in part, of any of its obligations to you, or for any damages or losses you may suffer, if the non-performance, damages or losses result from an event of force majeure or a circumstance beyond its control.
